Summons to give an explanation

Giving an explanation is not a formality. What you say can carry real weight — so do not go without a lawyer.

When and how to involve a lawyer

Contact a lawyer immediately — before the appointment. You have the right to legal help and it is wise to use it before you say anything. If you cannot make the date with a lawyer, you can ask to postpone it.

Find a lawyer

What not to do

  • Do not give an explanation without first consulting a lawyer, even "just as a witness".
  • Do not answer questions you do not fully understand — say you want a lawyer.
  • Do not sign a record you have not read or do not agree with.
  • Do not invent or embellish anything "to sound better".

Record right away

  • The exact date, time and place you are summoned to.
  • In what capacity you are called (witness, suspect, explanation under §158).
  • The file number and contact of the police authority.
  • The questions you were asked and what you answered (write it down afterwards from memory).

Your rights

  • You have the right to a lawyer already when giving an explanation.
  • You may refuse an explanation that could expose you or a close person to prosecution.
  • You have the right to an interpreter if you do not understand the language well.
  • You have the right to read the record and request corrections before signing.
